Welcome to SecureBird. These Terms of Use (“Terms”) govern your access to and use of the SecureBird website located at [securebird.org] (the “Site”), including any content, digital products, downloads, and services offered by SecureBird LLC (“SecureBird,” “we,” “us,” or “our”).
By accessing, purchasing, downloading, or using any part of the Site or SecureBird offerings, you (“User,” “you,” or “your”) agree to be bound by these Terms.
1. Use of the Site
You agree to use the Site solely for lawful purposes and in accordance with these Terms.
You shall not:
- Use the Site in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to systems, data, or infrastructure
- Interfere with or disrupt the operation or security of the Site
2. Digital Products & Licensing
All SecureBird digital products—including policies, standards, baselines, templates, frameworks, tools, and related materials (“Products”)—are licensed, not sold.
Upon purchase, SecureBird grants you a limited, non-exclusive, non-transferable license to use the Product for your organization’s internal business purposes only.
3. Permitted Use of Products
You may:
- Use Products within your internal business operations
- Modify, adapt, and customize Products to align with your internal policies, systems, and risk tolerance
- Incorporate Products into internal governance, risk, and compliance documentation
- Provide Products to auditors, regulators, and examiners solely for audit, compliance, or regulatory purposes
4. Controlled Third-Party Access
You may provide access to Products to:
- Employees
- Individual contractors or temporary staff
- Managed service providers performing internal operational support
provided that such parties:
- Have a legitimate need to access the Product for your internal business purposes
- Are bound by confidentiality obligations no less restrictive than these Terms
- Do not use the Product for independent commercial, consulting, advisory, or external service delivery purposes
For the avoidance of doubt, affiliates, parent companies, and subsidiaries are considered third parties unless subject to these same restrictions.
5. Restrictions on Use
You shall not:
- Share, distribute, reproduce, sublicense, or otherwise transfer Products to any third party except as expressly permitted
- Use Products to provide consulting, advisory, or managed services to external clients
- Provide Products to external consulting firms, system integrators, or advisory providers for the purpose of delivering services without SecureBird’s prior written consent
- Resell or commercially exploit Products in any form
- Create derivative works for external commercial use, redistribution, or competitive purposes
- Extract, deconstruct, reverse engineer, or otherwise attempt to derive underlying methodologies, frameworks, or models for external or commercial use
6. Intellectual Property
All content on the Site and all Products are the exclusive intellectual property of SecureBird.
No ownership rights are transferred. All rights not expressly granted are reserved.
All modifications, adaptations, and derivative materials created by you remain subject to SecureBird’s underlying intellectual property rights.
7. Payments & Refunds
All purchases are final unless otherwise stated.
Due to the nature of digital products, SecureBird does not provide refunds once a Product has been accessed or downloaded.
8. Disclaimer of Warranties
The Site and all Products are provided “as is” and “as available.”
SecureBird makes no representations or warranties, express or implied, regarding:
- Accuracy
- Completeness
- Reliability
- Fitness for a particular purpose
9. Limitation of Liability
To the maximum extent permitted by law, SecureBird shall not be liable for any:
- Cybersecurity incidents
- Control failures
- Regulatory findings
- Data breaches
- Loss of business, revenue, or profits
- Direct, indirect, incidental, or consequential damages
arising from the use or inability to use the Site or Products.
10. Indemnification
You agree to indemnify and hold harmless SecureBird from any claims, damages, liabilities, or expenses arising from your use of the Site or Products, including misuse or violation of these Terms.
11. Governing Law
These Terms shall be governed by the laws of the State of Kansas, without regard to conflict of law principles.
12. Modifications

Continued use of the Site constitutes acceptance of the updated Terms.
